1. Acceptance of Terms

By accessing or using the Action Diary web application (“the App”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, do not use the App.

2. Description of Service

Action Diary is a productivity and self-improvement tool that helps users track daily priorities, manage focus sessions, monitor habits, and reflect on their day. The App provides:

• A six-screen daily workflow (Priorities, Focus, Spot Check, Todo List, Shutdown Ritual, Calendar Tracker)
• Anonymous cloud sync via a browser-generated identifier
• Local data storage in your browser for offline access
• Star-based scoring and streak tracking

The App offers both free and paid (“Pro”) tiers. Free tier features include full access to all six screens with 30-day history and anonymous cloud sync. Pro tier features include unlimited history, advanced analytics, data export, and additional features as described on the App.

3. Accounts & Anonymous Access

Currently, the App operates without requiring user accounts. Your data is linked to an anonymous identifier stored in your browser. You acknowledge that clearing browser data may result in permanent loss of access to your cloud-stored data. Future account features may allow recovery and cross-device persistence beyond the anonymous identifier.

4. User Conduct

You agree not to:

• Use the App for any unlawful purpose
• Attempt to gain unauthorized access to the backend systems or other users' data
• Interfere with the App's functionality or send malicious code
• Scrape, crawl, or extract data from the App without permission
• Use automated means to access the App except for approved APIs

5. Subscriptions & Payments

5.1 Billing

Pro subscriptions are billed monthly ($4.99/mo) or annually ($39.99/yr) via Stripe. Charges are recurring until you cancel. You may cancel at any time, and access continues until the end of the current billing period.

5.2 Refunds

We offer refunds within 7 days of purchase upon request. After 7 days, no refunds are issued for partial billing periods. Annual subscription refunds are prorated based on remaining months.

5.3 Price Changes

We may adjust pricing with 30 days' notice. Existing subscribers retain their current rate until renewal.

6. Intellectual Property

The App, its content, features, and branding are owned by Action Diary and protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, modify, or create derivative works without our express written consent.

Your own entries (priorities, notes, reflections) remain yours. By using the App, you grant us a license to store and process this data solely for providing the service.

7. Disclaimers

7.1 No Professional Advice

Action Diary is a productivity and self-improvement tool. It does not provide professional advice of any kind — medical, psychological, financial, legal, or otherwise. Content related to financial literacy, habit formation, or skill development is for educational purposes only. Consult a qualified professional for personalized guidance.

7.2 AI-Generated Content (Future Feature)

When AI-powered features become available, AI-generated output may contain inaccuracies, omissions, or inappropriate content. AI suggestions are assistive only and should not replace independent judgment or professional consultation. Users are responsible for reviewing and validating any AI-generated content before acting on it.

7.3 Service Provided "As Is"

The App is provided “as is” without warranties of any kind, express or implied, including but not limited to merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee uninterrupted, error-free, or secure operation of the App.

8. Limitation of Liability

To the maximum extent permitted by law, Action Diary and its owners, contributors, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the App, including but not limited to data loss, lost productivity, or reliance on App content.

Our total liability for any claim shall not exceed the amount you paid us in the 12 months preceding the claim. For free-tier users, our total liability is limited to $0.

9. Data Ownership & Deletion

You own your entries. You may request deletion of your data at any time by contacting us (see Section 12). Upon deletion, your cloud-stored data will be permanently removed within 30 days. Deletion is irreversible.

10. Modifications to Terms

We may update these Terms periodically. Continued use of the App after changes constitutes acceptance of the new Terms. Material changes will be communicated via the App or email (if you have an account).

11. Governing Law

These Terms are governed by the laws of the United States, without regard to conflict of law principles. Any disputes shall be resolved in the courts of appropriate jurisdiction.
